These Terms of Use ("Terms") govern your access to and use of the Anestha mobile application, related websites, and services (collectively, the "Service"), operated by Anestha ("we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Anestha is a training and educational platform: an interactive simulator and study guide for dental local anaesthesia techniques, intended for dental students, faculty, and dental professionals. The Service is provided for educational and training purposes only.
Anestha is a guide and practice tool. It is not a substitute for formal education, professional guidance, or faculty supervision.
The Service does not provide medical or dental advice, and no doctor–patient or professional–client relationship is created by its use.
The Service is intended for users aged 18 or older. By using the Service you represent that you are at least 18 years old. We do not knowingly permit use of the Service by anyone under 18.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial educational use (or your institution's authorised educational use). You may not:
The Service, including its software, 3D models, simulations, text, graphics, logos, and trademarks, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights other than the limited licence above. Feedback you send us may be used to improve the Service without obligation to you.
The Service depends on third-party platforms and services (such as the Apple App Store, Google Play, and Unity services) that have their own terms and policies. We are not responsible for third-party services.
We may update, change, suspend, or discontinue the Service or any feature at any time, including for maintenance and updates to educational content. We aim for high availability but the Service is provided without uptime guarantees.
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if your institution's licence ends. Sections 2, 8, and 12–15 survive termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE, ITS SIMULATIONS, OR ITS EDUCATIONAL CONTENT ARE COMPLETE, ACCURATE, ERROR-FREE, OR CURRENT FOR ANY PARTICULAR JURISDICTION OR CLINICAL CONTEXT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS ARISING FROM CLINICAL ACTS OR OMISSIONS PERFORMED ON REAL PATIENTS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or any procedure you perform on a real patient.
These Terms are governed by the laws of New Zealand, without regard to conflict-of-law rules, and disputes are subject to the exclusive jurisdiction of the courts of New Zealand. Mandatory consumer protections of your country of residence remain unaffected where they apply.
We may update these Terms from time to time. Material changes will be announced in the app or on our website before they take effect, and the "Last updated" date above will be revised. Continued use of the Service after changes take effect constitutes acceptance.
