Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Anestha mobile application, related websites, and services (collectively, the "Service"), operated by Anestha ("we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About Anestha

Anestha is a training and educational platform: an interactive simulator and study guide for dental local anaesthesia techniques, intended for dental students, faculty, and dental professionals. The Service is provided for educational and training purposes only.

2. Educational Use Only — No Medical Advice

Anestha is a guide and practice tool. It is not a substitute for formal education, professional guidance, or faculty supervision.

You must not rely solely on the Service when learning or performing any clinical procedure. Simulated anatomy, technique parameters, and feedback are simplifications and may differ from real patients and real clinical conditions.
The Service does not replace the guidance of licensed professionals, instructors, or professors, and does not confer clinical competence, certification, or authorisation to perform any procedure.
Any clinical procedure on a real patient must be performed only under appropriate professional training, supervision, licensure, and institutional protocols.
Always consult current local guidelines, institutional protocols, and official prescribing information regarding the correct anaesthetic agent, concentration, dosage, and contraindications for each patient and jurisdiction. Drug availability and protocols vary by country and institution.
We accept no responsibility or liability for any incorrect, unsafe, or harmful procedure performed on a real patient, or for any clinical decision made in reliance on the Service.

The Service does not provide medical or dental advice, and no doctor–patient or professional–client relationship is created by its use.

3. Eligibility

The Service is intended for users aged 18 or older. By using the Service you represent that you are at least 18 years old. We do not knowingly permit use of the Service by anyone under 18.

4. Accounts

You must provide accurate registration information (such as name, email, institution, and course/year) and keep it up to date.
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Accounts and licence seats are personal and may not be shared.
Notify us at support@anestha.training if you suspect unauthorised use of your account.

5. Individual Subscriptions

Individual access to the Service is offered on a subscription basis, billed through the Apple App Store or Google Play ("App Store").
Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the period ends. Manage or cancel your subscription in your App Store account settings; deleting the app does not cancel a subscription.
Prices may change; changes apply from the next billing period after reasonable notice through the App Store.
Payment, billing, and refunds are handled by the App Store under its own terms. Except where required by law, payments are non-refundable.
If a free trial is offered, unused trial time is forfeited when a subscription is purchased, and the subscription begins automatically at the end of the trial unless cancelled.

6. Institutional Licences (Universities and Dental Schools)

Universities, dental schools, and other institutions may purchase access through seat-based licences under a separate agreement with us. Where that agreement conflicts with these Terms, the agreement prevails for that institution and its users.
Seats are assigned by the institution to named students or staff and may not be shared, transferred, or resold except as the institutional agreement allows.
If your access is provided through an institution, your institution controls the duration and scope of your access, and your usage and performance data may be visible to your institution's instructors and professors (see our Privacy Policy).
Institutions are responsible for ensuring their users comply with these Terms.

7. Licence and Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial educational use (or your institution's authorised educational use). You may not:

copy, modify, distribute, sell, rent, or sublicense the Service or any part of it;
reverse engineer, decompile, or attempt to extract the source code, models, or content, except where such restriction is prohibited by law;
use the Service to build a competing product, or scrape or bulk-extract its content;
circumvent security, licensing, or seat-management mechanisms;
use the Service in any unlawful manner or in violation of institutional rules.

8. Intellectual Property

The Service, including its software, 3D models, simulations, text, graphics, logos, and trademarks, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights other than the limited licence above. Feedback you send us may be used to improve the Service without obligation to you.

9. Third-Party Services

The Service depends on third-party platforms and services (such as the Apple App Store, Google Play, and Unity services) that have their own terms and policies. We are not responsible for third-party services.

10. Availability and Changes to the Service

We may update, change, suspend, or discontinue the Service or any feature at any time, including for maintenance and updates to educational content. We aim for high availability but the Service is provided without uptime guarantees.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if your institution's licence ends. Sections 2, 8, and 12–15 survive termination.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE, ITS SIMULATIONS, OR ITS EDUCATIONAL CONTENT ARE COMPLETE, ACCURATE, ERROR-FREE, OR CURRENT FOR ANY PARTICULAR JURISDICTION OR CLINICAL CONTEXT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS ARISING FROM CLINICAL ACTS OR OMISSIONS PERFORMED ON REAL PATIENTS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

14. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or any procedure you perform on a real patient.

15. Governing Law

These Terms are governed by the laws of New Zealand, without regard to conflict-of-law rules, and disputes are subject to the exclusive jurisdiction of the courts of New Zealand. Mandatory consumer protections of your country of residence remain unaffected where they apply.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in the app or on our website before they take effect, and the "Last updated" date above will be revised. Continued use of the Service after changes take effect constitutes acceptance.
